That is the date Resolution 109\/2023 took effect, and it splits your service into two claims with two different payers. Miss one and you leave money behind.<\/p>\n\n\n<div class=\"alrasly-split\"><div class=\"alrasly-split__side\"><p class=\"alrasly-split__who\">Your employer<\/p><p class=\"alrasly-split__when\">Service before 1 March 2024<\/p><p class=\"alrasly-split__how\">You claim it from the company directly. Article 14 leaves this period under Labour Law 36\/2012.<\/p><\/div><div class=\"alrasly-split__pivot\">1 March<br>2024<\/div><div class=\"alrasly-split__side alrasly-split__side--sio\"><p class=\"alrasly-split__who\">SIO<\/p><p class=\"alrasly-split__when\">Service from 1 March 2024<\/p><p class=\"alrasly-split__how\">You claim it from the Social Insurance Organisation, which your employer has been paying contributions to.<\/p><\/div><\/div>\n\n\n<div class=\"alrasly-callout\"><p><strong>Do not claim both halves from the same place.<\/strong> Each party is responsible for its own period, and neither will tell you about the other one. The calculator above splits that total between your employer and SIO by date.<\/p><\/div>\n\n\n<div class=\"alrasly-callout\"><p><strong>It is calculated on your last wage, not the wage you earned at the time.<\/strong> Articles 10 and 116 both specify the final remuneration, so a raise in your last year raises the whole entitlement, including the early years.<\/p><\/div>\n\n<\/div>\n\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull alrasly-gsec has-ground-background-color has-background is-layout-flow wp-block-group-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--60)\">\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n\n<h2 class=\"wp-block-heading\">What counts as your wage?<\/h2>\n\n\n<p class=\"wp-block-paragraph\">This is the most common error, and it runs in both directions \u2014 people use their full package and get a figure far too high, or use take-home pay and get one too low.<\/p>\n\n\n<div class=\"alrasly-inout\"><div class=\"alrasly-inout__col alrasly-inout__col--in\"><p class=\"alrasly-inout__head\">Counts<\/p><ul><li>Basic salary<\/li><li>Social allowance<\/li><\/ul><\/div><div class=\"alrasly-inout__col alrasly-inout__col--out\"><p class=\"alrasly-inout__head\">Does not count<\/p><ul><li>Housing allowance<\/li><li>Transport or car allowance<\/li><li>Phone allowance<\/li><li>Overtime, bonuses and commission<\/li><\/ul><\/div><\/div>\n\n\n<p class=\"wp-block-paragraph\">Article 1 of the regulation defines the wage as the contract amount plus increases and social allowance. SIO&rsquo;s own guidance says the same and excludes all other allowances and benefits.<\/p>\n\n<\/div>\n\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull alrasly-gsec has-ground-alt-background-color has-background is-layout-flow wp-block-group-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--60)\">\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n\n<h2 class=\"wp-block-heading\">Is there a minimum service period?<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong> Neither instrument contains one. Article 9 grants entitlement to fractions of a year in proportion to service, Article 116 says the same, and Article 2 applies the regulation &ldquo;whatever the duration, nature or form of the contract&rdquo;.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Eight months of service earns eight twelfths of half a month&rsquo;s wage. If you have been told you get nothing under a year, that is wrong.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Does resigning reduce what you are owed?<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong> Article 116 draws no distinction by reason for leaving \u2014 resignation, non-renewal and dismissal all earn the same entitlement. The only forfeiture is the gross-misconduct case in Article 107.<\/p>\n\n<\/div>\n\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull alrasly-gsec has-ground-background-color has-background is-layout-flow wp-block-group-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--60)\">\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n\n<h2 class=\"wp-block-heading\">Can SIO pay you less than the calculator says?<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes \u2014 and this is the part almost nobody is told.<\/strong><\/p>\n\n\n<div class=\"alrasly-callout alrasly-callout--warn\"><p><strong>Article 10:<\/strong> the benefit is calculated on your last remuneration <em>and not exceeding the amount of the contributions paid on your behalf<\/em>. The formula is a ceiling, not a guarantee. If your employer under-contributed or did not contribute at all, SIO pays what it received \u2014 not what the formula produces.<\/p><\/div>\n\n\n<p class=\"wp-block-paragraph\">So the figure that matters is not only the one this calculator gives you. Check what has actually been paid in, in your account on the SIO portal, and enter it in the optional field above \u2014 the tool will tell you whether the cap bites. If it passes, you have something specific to point at.<\/p>\n\n\n<h2 class=\"wp-block-heading\">What if your employer will not pay?<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Take it to the <strong>Expat Protection Centre at the Labour Market Regulatory Authority (LMRA)<\/strong>, in Northern Sehla. That is the route SIO itself names for a delayed payment or short contributions \u2014 not the Ministry of Labour.<\/p>\n\n<\/div>\n\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull alrasly-gsec has-ground-background-color has-background is-layout-flow wp-block-group-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--60)\">\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n\n<h2 class=\"wp-block-heading\">Who is not covered by this?<\/h2>\n\n\n<figure class=\"wp-block-table alrasly-table\"><table><thead><tr><th>Who<\/th><th>Position<\/th><th>Source<\/th><\/tr><\/thead><tbody><tr><td><strong>GCC nationals<\/strong><\/td><td>Excepted \u2014 covered instead by the unified GCC insurance regulation, Law 68\/2006<\/td><td>Article 3<\/td><\/tr><tr><td><strong>Bahraini nationals<\/strong><\/td><td>Outside this regulation, which applies to non-Bahrainis. That is deliberate: the figure circulating for Bahrainis has no source in either instrument, and a confident wrong answer about someone&rsquo;s entitlement is worse than no answer.<\/p><\/div>\n\n<\/div>\n\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull alrasly-gsec has-ground-alt-background-color has-background is-layout-flow wp-block-group-is-layout-flow\" style=\"padding-top:var(--wp--preset--spacing--60);padding-bottom:var(--wp--preset--spacing--60)\">\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n\n<h2 class=\"wp-block-heading\">What does not break your service?<\/h2>\n\n\n<div class=\"alrasly-ref\"><div class=\"alrasly-ref__item\"><p class=\"alrasly-ref__term\">Moving within the same employer<\/p><p class=\"alrasly-ref__def\">A transfer to another branch or enterprise of the same employer is not an end of service. Your service continues and so does the accrual.<\/p><span class=\"alrasly-ref__art\">Article 6<\/span><\/div><div class=\"alrasly-ref__item\"><p class=\"alrasly-ref__term\">The business changing hands<\/p><p class=\"alrasly-ref__def\">If ownership transfers, contributions carry on and your service is not broken.<\/p><span class=\"alrasly-ref__art\">Article 7<\/span><\/div><div class=\"alrasly-ref__item\"><p class=\"alrasly-ref__term\">Having moved between companies<\/p><p class=\"alrasly-ref__def\">Entitlement earned with a previous employer survives the move. It does not vanish because you changed jobs.<\/p><span class=\"alrasly-ref__art\">SIO guidance<\/span><\/div><div class=\"alrasly-ref__item\"><p class=\"alrasly-ref__term\">Death in service<\/p><p class=\"alrasly-ref__def\">The benefit is paid to the beneficiaries according to the inheritance system of the deceased&rsquo;s home country.<\/p><span class=\"alrasly-ref__art\">Article 11<\/span><\/div><\/div>\n\n\n<p class=\"wp-block-paragraph\">Unpaid leave is the exception that does reduce it: Article 8 covers the duration of <em>actual<\/em> service for which contributions were paid, so unpaid days come off before the calculation. UAE gratuity is 21 days&rsquo; pay per year for the first five years and 30 days after, under Federal Decree-Law 33 of 2021, and there is no employer\/SIO split. A UAE calculator will give you the right number; this one will not.<\/p><\/div><\/details><details class=\"alrasly-qa__item\"><summary><h3>Is &ldquo;indemnity&rdquo; the same as &ldquo;gratuity&rdquo;?<\/h3><\/summary><div class=\"alrasly-qa__a\"><p>Yes. Indemnity is the word used in Bahrain, gratuity is the more common term elsewhere in the Gulf, and the regulation itself says end-of-service benefits.
